1. Terms of Service

1.1 Acceptance

By accessing or using Chekbio ("Service"), operated by Chekbio ("we", "us", "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

1.2 Description of Service

Chekbio is an AI-powered link-in-bio platform that allows users to create, manage, and publish a personal or business profile page. The Service includes a web dashboard, chat-based bot integrations, automated content syncing, and built-in analytics.

1.3 Eligibility

You must be at least 16 years of age to use the Service. By using Chekbio, you represent that you meet this requirement and have the legal capacity to enter into these terms.

1.4 Account Registration

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

1.5 Username Policy

Usernames are available on a first-come, first-served basis. We reserve the right to reclaim, suspend, or reassign usernames that are inactive for an extended period, violate trademarks, or are registered in bad faith (e.g., squatting, impersonation).

1.6 Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or to promote illegal activities
• Post content that is defamatory, obscene, hateful, or infringes on third-party rights
• Impersonate any person or entity, or misrepresent your affiliation
• Attempt to gain unauthorized access to the Service, other accounts, or related systems
• Use automated means (bots, scrapers) to access the Service beyond the provided integrations
• Interfere with or disrupt the integrity or performance of the Service
• Upload malicious code, viruses, or any harmful content
• Resell, sublicense, or redistribute the Service without prior written consent

1.7 Content Ownership

You retain ownership of all content you upload or create through the Service ("User Content"). By posting User Content, you grant Chekbio a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content solely for the purpose of operating and improving the Service. This license terminates when you delete your content or account.

1.8 Third-Party Content & Integrations

The Service may pull or sync content from third-party platforms on your behalf. You are solely responsible for ensuring you have the right to use and display such content. Chekbio is not liable for third-party content accuracy, availability, or compliance.

1.9 AI-Assisted Features

Chekbio uses artificial intelligence to assist with content management and conversational interactions. AI outputs are provided "as is" and may contain errors. You are responsible for reviewing and approving any AI-assisted content before publishing.

1.10 Subscriptions & Payments

Certain features require a paid subscription. Subscription fees are billed in advance on a recurring basis (monthly). All fees are in Indian Rupees (INR) unless otherwise stated. Payments are processed securely through our payment partner. By subscribing, you authorize recurring charges to your payment method.

• Free trial: If offered, the trial period and terms will be stated at signup.
• Cancellation: You may cancel at any time. Access continues until the end of the current billing period. No partial refunds are provided for unused time.
• Price changes: We may adjust pricing with at least 30 days' notice. Continued use after the effective date constitutes acceptance.
• Failed payments: If payment fails, we may downgrade your account to the free tier after a reasonable grace period.

1.11 Termination

We may suspend or terminate your account at our discretion if you violate these terms, with or without notice. Upon termination, your right to use the Service ceases immediately. We may delete your data after a reasonable retention period. You may also delete your account at any time through the dashboard.

1.12 Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

1.13 Limitation of Liability

To the maximum extent permitted by law, Chekbio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

1.14 Indemnification

You agree to indemnify and hold Chekbio harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your User Content, or your violation of these terms.

1.15 Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or a notice on the Service. Continued use after changes take effect constitutes acceptance of the revised terms.

2. Privacy Policy

2.1 Information We Collect

We collect information in the following ways:

• Account information: Email address, username, and social media handles you provide during registration or onboarding.
• Profile content: Bio data, blocks, links, images, and other content you add to your profile.
• Usage data: Page views, link clicks, feature usage, device type, browser, IP address, and referral sources — collected automatically.
• Bot interactions: Messages exchanged with our chat bots to process your requests.
• Payment information: Processed securely by our payment partner. We store subscription status but never your card details.
• Waitlist data: Email and claimed username when you join our pre-launch waitlist.

2.2 How We Use Your Information

• To provide, maintain, and improve the Service
• To create and manage your account and public profile
• To process payments and manage subscriptions
• To provide analytics on your profile's performance
• To process bot commands and deliver conversational features
• To send transactional emails (account verification, payment receipts, service updates)
• To send marketing communications (only with your consent; you can opt out anytime)
• To detect and prevent fraud, abuse, and security incidents
• To comply with legal obligations

2.3 AI & Data Processing

We use third-party AI services to power our conversational bot and content features. Your bot messages may be sent to these services for processing. We do not use your personal data to train AI models. AI providers process data under their own privacy policies and our data processing agreements.

2.4 Data Sharing

We do not sell your personal data. We share information only in these cases:

• Public profile: Your profile page (username, bio, blocks, links) is publicly visible by design.
• Service providers: We use trusted third-party services for authentication, payments, and AI features that process data on our behalf under confidentiality obligations.
• Legal requirements: We may disclose information when required by law, subpoena, or to protect our rights and safety.
• Business transfers: In the event of a merger, acquisition, or sale of assets, your data may be transferred as part of the transaction.

2.5 Data Storage & Security

Your data is stored on secure, managed cloud infrastructure. We use industry-standard encryption (in transit and at rest), token-based authentication, and regular security reviews. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

2.6 Data Retention

• Active accounts: Data is retained as long as your account is active.
• Deleted accounts: We delete your personal data within 30 days of account deletion, except where required for legal or legitimate business purposes.
• Analytics data: Aggregated, non-identifiable analytics may be retained indefinitely.
• Waitlist data: Retained until launch or until you request removal.

2.7 Cookies & Tracking

We use essential cookies for authentication and session management. We do not use third-party advertising cookies. Analytics are first-party only — we do not share your browsing data with ad networks.

2.8 Your Rights

Depending on your jurisdiction, you may have the right to:

• Access the personal data we hold about you
• Correct inaccurate or incomplete data
• Delete your account and associated data
• Export your data in a portable format
• Object to or restrict certain processing
• Withdraw consent for marketing communications

2.9 Children's Privacy

The Service is not directed to children under 16. We do not knowingly collect personal data from children. If we become aware that a child has provided us with personal data, we will delete it promptly.

2.10 International Users

Chekbio is operated from India. If you access the Service from outside India, your data may be transferred to and processed in India. By using the Service, you consent to this transfer.

3. General

3.1 Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

3.2 Severability

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

3.3 Entire Agreement

These terms, together with the Privacy Policy, constitute the entire agreement between you and Chekbio regarding your use of the Service.
